These Terms of Use ("Terms") govern your access to and use of Hirempire's platform, website, and related services (collectively, the "Service"), operated by Hirempire ("Company", "we", "us", or "our"). By creating an account or accessing the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your organization. By using the Service, you represent and warrant that you meet these requirements.
2. Account Registration
- Accurate Information: You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
- Account Security: You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
- One Account Per User: You may not create multiple accounts, share your account with others, or transfer your account to any third party without our prior written consent.
3. Permitted Use
You may use Hirempire solely for lawful recruitment and hiring-related purposes. You agree not to:
- Use the Service to post fraudulent, misleading, or discriminatory job listings.
- Harvest, scrape, or collect data from the platform without our express written permission.
- Reverse-engineer, decompile, or attempt to extract source code from the Service.
- Use the Service to transmit spam, malware, or any unsolicited communications.
- Circumvent, disable, or interfere with security features of the Service.
- Use the Service in any manner that violates applicable local, national, or international law.
4. Subscription & Payments
- Plans: Hirempire offers free and paid subscription plans. Paid plans are billed on a monthly or annual basis as selected at checkout.
- Billing: By providing a payment method, you authorize us to charge you the applicable fees. All fees are in USD unless stated otherwise.
- Free Trial: If you start a free trial, you will not be charged until the trial period ends. You may cancel before the trial expires to avoid charges.
- Refunds: Except where required by law, subscription fees are non-refundable. If you believe a charge was made in error, contact us within 14 days of the charge.
- Price Changes: We reserve the right to modify our pricing at any time. You will be notified at least 30 days before any price change takes effect.
5. AI Features & Generated Content
Hirempire uses artificial intelligence to power features such as candidate screening, job description generation, and automated follow-ups. You acknowledge that:
- AI-generated content (including screening scores and job descriptions) is provided for informational purposes and should not be the sole basis for hiring decisions.
- You are solely responsible for reviewing AI outputs and ensuring compliance with applicable employment laws and anti-discrimination regulations.
- Hirempire does not guarantee the accuracy, completeness, or fitness of AI-generated content for any particular purpose.
6. Candidate Data & Compliance
When you use Hirempire to manage candidate information, you act as a data controller. You agree to:
- Obtain any necessary consents from candidates before storing or processing their personal data on the platform.
- Use candidate data only for legitimate recruitment purposes and not share it with unauthorized third parties.
- Comply with all applicable data protection laws, including GDPR, CCPA, and any other regulations that apply to your jurisdiction.
- Promptly delete candidate data upon request or when no longer needed for the purpose for which it was collected.
7. Third-Party Integrations
The Service integrates with third-party tools including Cal.com, Gmail, Outlook, LinkedIn, and Slack. Your use of these integrations is subject to the respective third-party terms and privacy policies. Hirempire is not responsible for the availability, accuracy, or practices of any third-party service.
8. Intellectual Property
All content, software, trademarks, logos, and materials provided through the Service are the exclusive property of Hirempire or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for its intended purposes.
You retain ownership of any content you upload or create through the Service (such as job descriptions or candidate notes). By submitting content, you grant Hirempire a non-exclusive, royalty-free license to use, store, and process it solely to provide and improve the Service.
9. Confidentiality
You agree to keep confidential any non-public information you receive about Hirempire's technology, pricing, or business operations through your use of the Service, and not to disclose it to any third party without our prior written consent.
10. Termination
- By You: You may cancel your account at any time from your account settings. Cancellation takes effect at the end of the current billing period.
- By Us: We may suspend or terminate your account immediately, without notice, if you violate these Terms, engage in fraudulent activity, or pose a risk to other users or the Service.
- Effect of Termination: Upon termination, your right to access the Service ceases. We may retain certain data as required by law or our data retention policies.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
12. Limitation of Liability
To the fullest extent permitted by law, Hirempire shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim arising under these Terms shall not exceed the amount you paid to us in the three months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless Hirempire, its officers, employees, and partners from any claims, losses, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
14. Governing Law & Disputes
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction.
15. Electronic Signature Policy
Nature of Our Electronic Signatures
Hirempire's e-signature feature produces Simple Electronic Signatures (SES) — a typed name rendered in a chosen style, linked to a cryptographically verifiable audit trail. Simple Electronic Signatures are legally recognized for the majority of commercial and employment transactions worldwide. They are not Advanced Electronic Signatures (AES) or Qualified Electronic Signatures (QES), which require identity certificates issued by a licensed Certificate Authority. Where a higher signature tier is legally required for your document type or jurisdiction, you must use an appropriately certified provider.
Global Legal Recognition
Electronic signatures are broadly recognized by law in over 60 countries. Hirempire's signatures meet the core requirements shared across virtually all frameworks: signer identity, intent to sign, consent, and document integrity. Key regional frameworks include:

Excluded Document Types (Universal)
Regardless of jurisdiction, electronic signatures are generally not valid for: wills and testamentary documents; marriage, divorce, and family status documents; real estate title transfers; negotiable instruments (checks, promissory notes, bills of exchange); court filings requiring wet signatures; adoption, custody, and guardianship documents; and any document where the governing law explicitly excludes electronic execution.
Audit Trail We Maintain
For every signed document, Hirempire records and permanently stores the following for each signing party:
- Full name and email address of the signer
- Timestamp (UTC) of signing and of explicit consent
- IP address and resolved country at the time of signing
- Browser and device information (User-Agent)
- SHA-256 cryptographic hash of the signed PDF for tamper-evidence
- Consent confirmation — signers must actively check a consent box before signing is permitted
Document Retention
Signed documents and their full audit records are retained for a minimum of 5 years from the date of signing. Hirempire is not responsible for documents deleted by the account holder or lost as a result of account termination.
Your Responsibility
The recruiter or employer initiating a signature request is solely responsible for determining whether a Simple Electronic Signature is legally sufficient for their specific document type, industry, and jurisdiction. Hirempire does not provide legal advice. When in doubt, consult a qualified lawyer in the relevant jurisdiction.
Audit Trail Requests
To obtain the audit trail for a specific signed document (e.g., for legal proceedings), contact [email protected] with the document name and approximate signing date.
16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or a notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
